Termite protection requirements in NSW
- The National Construction Code’s termite provisions apply in NSW with no NSW variation: Volume One clause B1D4(i) for Class 2 to 9 buildings, and Part 3.4 of the Housing Provisions for Class 1 and 10 buildings.
- NSW uses NCC 2022 (Amendment 2) until NCC 2025 starts on 1 May 2027.
- The NSW Government says the builder is responsible for installing the termite risk management system.
- Where the system contains a pesticide, installers need the appropriate NSW licence: a timber pest management technician licence from the EPA, or a contractor licence under the Home Building Act for dual-purpose moisture and termite barriers.
Certificates for Northern Rivers councils
Northern Rivers councils ask for evidence of termite protection before the occupation certificate is issued. For example:
- Tweed Shire: termite control by a licensed contractor is on the occupation certificate list.
- Ballina Shire: a certification of termite protection is lodged before the occupation certificate.
- Byron Shire: certification of termite protection to AS 3660.1-2014, including the installer’s licence number.
- Clarence Valley: a compliance certificate for physical termite protection to AS 3660.1-2014 and the Housing Provisions.
